Second Amendment: Modern Arms, Due Process, and Public Safety

The strongest objection from gun-rights advocates is that every new regulatory lane becomes the next excuse for a registry, confiscation, selective enforcement, or permanent deprivation after a temporary allegation. The strongest objection from gun-safety advocates is that a rights-first approach leaves too many dangerous weapons in circulation and moves too slowly for domestic-violence victims and high-risk communities.

Both objections identify failure modes. The answer is not to dismiss either side. It is to make the due-process machinery and the safety machinery the same machinery: credible threat findings, prompt hearings, traceable commercial supply, clear statutes, fast appeals, and return of property when the state cannot carry its burden. A rule that cannot survive that discipline should not be the party's rule.

Lawful gun owners bear compliance costs, delays, and the risk of wrongful denial or temporary loss of property. Dealers and manufacturers bear marking, recordkeeping, and transfer costs. Domestic-violence survivors and communities facing gun violence bear danger if orders are too slow or enforcement fails. Investigators bear the cost of tracing and proving cases under clearer but sometimes narrower rules. Those costs are acceptable only with fast appeals, record correction, return-of-property rules, support for small dealers, and serious enforcement against prohibited possessors and illegal conversion-device markets.
